How to use an on-line store - Rules and regulations
§1 Preliminary provisions
- These rules and regulations specify the rules of operation and use of an on-line store of the website address https://www.sotebuy.com/sotebuy based on an internet platform available via SOTEBUY as well as the rights and duties of the Seller and the Buyer.
- Prior to their use of the on-line store services, the Buyer is obliged to read these Rules and Regulations and accept them.
- The Owner of SOTEBUY is SOTE Jakubowicz Spółka Jawna with the registered office at ul. Wolsztyńska 2, 60-361 Poznań, REGON: 63451780900000, KRS: 0000173954.
- The Seller (owner of the on-line store) is SOTE Jakubowicz sp.j. seated in Wolsztyńska 2, 60-361 Poznań , Polska, NIP (VAT reg. no.): PL7792214156
- Users’ personal data is processed in line with provisions of Regulation (EU) No. 2016/679 of the European Parliament and of the Council of 27th April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and with regard to the repealing of Directive 95/46/EC (General Data Protection Regulation, hereinafter: GDPR). Provision and processing of the personal data of the Users is voluntary. The Users have the right to access to the contents of their respective data and to correct it, to demand its removal, transfer, limitation and to file an objection.
§2 Definitions
For the purposes of these Rules and Regulations, the following terms shall have the meaning as follows:
- SOTEBUY - service hosting the internet platform on which the Seller is entitled to operate his/her on-line store, within the framework of which the Seller sells items to the Buyer on terms and conditions specified in these Rules and Regulations.
- The Owner of SOTEBUY and the personal data administrator is SOTE Jakubowicz Spółka Jawna with the registered office at ul. Wolsztyńska 2, 60-361 Poznań, REGON: 63451780900000, KRS: 0000173954.
- Seller - an entrepreneur who has set up and who uses an account in SOTEBUY for the purpose of running an on-line store set up therein, and who by its means sells goods specified as to their kind to the Buyer.
- Buyer - a natural person, a legal person or a legal person without corporate status (unincorporated but having legal capacity), who via the on-line store, purchases from the Seller goods specified as to their kind.
- Privacy policy - a separate document specifying the principles of administering the personal data of users, which makes up an integral part of these Rules and Regulations in the form of an Appendix.
- Entrepreneur - a natural person, legal person or an organizational unit being an unincorporated legal person, granted with legal capacity under a separate law - that runs business or professional operations in their own name.
- Consumer - a natural person transacting a sales contract with the Entrepreneur, which contract is not directly related to the Consumer’s business or professional activity.
- Remote agreement – an agreement concluded by and between the entrepreneur and the consumer in accordance with the definition of art. 2 point 1 of the Consumer's rights of 30 May 2014 (Journal of Laws of 2014 item 827 as amended).
§3 Scope of Services
- The Buyer shall be entitled to place orders via the on-line store 24 hours a day, 7 days a week over the entire year.
- The sales agreement is concluded by and between the Seller and the Buyer via a form filled in by the Buyer, the Buyer’s acceptance of the Rules and Regulations and the Privacy Policy and the order confirmation.
- The Buyer shall be allowed to pay for the ordered goods as follows:
- Bank transfer
- Paypal
- The Seller shall commence the execution of an order placed by Buyer only when the Seller has received full payment for the order except for orders paid in cash on delivery.
- Any costs related to the payment and costs of delivery are provided on the order site and will be included in the total order price. The Seller may not demand from the consumer, for his use of a specified delivery form, a fee exceeding the actual costs borne by the Seller thereunder.
- The delivery date of an order placed by the Buyer cannot be longer than 14 working days except for the situation where on the product data sheet the Seller has expressly indicated another date of an order execution.
- The ordered goods are sent to the address indicated by the Buyer in the order form.
- The delivery is executed in the manner indicated by the Seller in the offer and at the price indicated therein.
- To confirm the payment for the provided service, the Seller shall send to the Buyer, at his discretion, either a receipt or a VAT invoice in an electronic form to the e-mail address provided by the Buyer in the form.
§4 Updates
- Services available in SOTEBUY are automatically updated.
- If the SOTEBUY is being updated, it is temporarily non-available.
- SOTEBUY shall provide information on its update with a 1 day prior notice. It also reserves the right to update SOTEBUY with no prior notice in emergency situations.
§5 Technical conditions
- In order to use SOTEBUY services properly, it is necessary:
- for the Buyer to have a computer or any other electronic device with such operating systems as: Mac OS X, Linux, Adroid or Windows,
- with an internet browser installed in the version as provided or higher: Internet Explorer – version 9, Chrome – version 46, Safari – version 8, Firefox – version 41, Opera – version 32,
- with activated cookies.
- To conclude a purchase transaction the Buyer must have an active e-mail account.
§6 Statutory right to withdraw from the agreement
- Within 14 days as of the conclusion of the agreement (setting up an account or conclusion of a sales and purchase agreement) the Buyer may withdraw from this agreement without provision of any reasons for such withdrawal and free of charge via sending a respective declaration on withdrawal to the e-mail address or to the address for correspondence of the Seller.
- To withdraw from the agreement, the Buyer may use a form enclosed to these Rules and Regulations.
- Should the Buyer withdraw from the agreement - the agreement shall be deemed non-concluded, whereas the Seller shall be obliged to forthwith - not later than within 14 days as of the receipt of the Buyer’s declaration on withdrawal from the agreement - refund all the payments made by the Buyer, in this the costs of delivery.
- If the Buyer has selected a delivery not being the cheapest form of delivery offered by the Seller, the Seller is not obliged to refund the such additional costs borne by the Buyer.
- The Buyer shall be obliged to return the product of the Seller, however not later than within 14 days as of the date of his withdrawal from the agreement. To meet the deadline it is sufficient to send the products back prior to the lapse of the deadline. The costs of the return of goods shall be borne by the Buyer.
- The Buyer shall be liable for the value impairment of the product due to his/her use of the product outside the scope necessary to confirm the product’s nature, features and functionalities.
- The aforementioned terms and conditions of the exercise of the statutory right of withdrawal from the agreement concern only the relations between a consumer and an entrepreneur within the framework of a remote agreement concluded by them.
§7 Complaints
- All and any complaints related to the services rendered by the Seller can be filed e–mail sent to the Seller: sotebuyeu@sotebuy.com or ordinary mail to the address: Wolsztyńska 2, 60-361 Poznań , Polska
- A complaint shall be forthwith reviewed - within 14 days as of its receipt at the latest.
- A reply concerning a complaint shall be sent to the e-mail address or to the address for correspondence provided by the Buyer in the order form.
- If no information is provided with respect to the review of the complaint within the deadline specified in point 2, the complaint shall be deemed as reviewed in favour of the Buyer.
§8 Liability of SOTEBUY owner
- SOTE Jakubowicz Spółka Jawna shall not be liable for the contents published in SOTEBUY by the Seller.
- If the Buyer decides to buy a product from the Seller, this is upon the exclusive liability of the Buyer. SOTEBUY owner as the provider of a technological tool shall in no way be liable for the transaction (its course and successful result).
- SOTEBUY owner is not liable for any intervals in the operation of SOTEBUY for reasons outside its control.
- SOTEBUY owner shall not be liable for the loss of data published on SOTEBUY due to a server or IT system failure/fault.
§9 Final provisions
- These Rules and Regulations are available under the address: https://www.sotebuy.com/sotebuy/terms
- The Buyer can read and download the contents of these rules and regulations onto their Device and print the document.
- The Seller shall have the right to make changes to these Rules and Regulations at any time for important reasons concerning changes in the legal regulations, Seller's decision on a change in the Material Terms of Service Provision or change in the scope of its business activity.
- The Rules and Regulations shall come into force and effect as of 27-03-2018 and shall be binding until any change or revocation.
- In scope not regulated in these rules and regulations, the provisions of the Law of 23 April 1964 the Civil Code (Journal of Laws no. 16 item 93 as amended) and the Law of 16 February 2007 on the protection of competition and consumers (Journal of Laws no. 50 item 330 as amended) and the Law of 30 May 2014 on consumer's rights (Journal of Laws of 2014 item 827 as amended) shall apply.
